The terms and conditions apply to all use of the FreshClick website and all services available through it. By using the FreshClick website and any BigCommerce apps you agree to be bound by these terms.
FreshClick has sole discretion to change or replace any part of this agreement. You are responsible for periodically checking it. New service additions or enhancements are subject to these Terms of Service, and continued use means you consent to changes.
FreshClick reserves the right to terminate your account if you violate the terms described below.
Account
Account terms
You are required to sign in to your FreshClick account either through your BigCommerce store or through www.freshclick.co.uk in order to use FreshClick.
You are solely responsible for maintaining the security of your account and password. Notify FreshClick of any security breach as soon as possible. FreshClick will not be liable for loss or damage if you fail to comply with this security obligation.
Accounts registered by automated methods are not allowed. You must be a real person to use the service.
You are responsible for all activity that happens under your account.
Free trials are only eligible once per store. FreshClick has the right to cancel free trials or extend them on request.
You may not use FreshClick for any illegal or unauthorized purpose and must not violate laws in your jurisdiction while using the service.
Payments
Account payments
You are billed in a monthly or yearly billing cycle and the credit card on record is charged automatically.
Payments are non-refundable. There will be no refunds for cancelling your account or downgrading your plan. Changes will be effective on the next billing cycle.
When you subscribe from a free trial to a paid plan, you will be billed immediately because the subscription cycle begins immediately after upgrade.
For upgrades or downgrades, the new rate takes effect from the time of the email notifying you of the package change, and the credit card will be charged the new rate on the next billing cycle.
Cancellation
Account termination or cancellation
You can cancel your account at any time by uninstalling the app. If you have a subscription, an email will be sent asking you to confirm cancellation. All content and profile information will be deleted from the FreshClick Service immediately upon uninstallation and cannot be recovered.
If you cancel before the end of the current billing cycle, you will not be charged after the end of that cycle.
FreshClick has the right to suspend or terminate your account with or without cause and with or without notice at any time. If terminated, content and profile information will be immediately deleted and you will no longer have access to your account. FreshClick reserves the right to refuse service to anyone for any reason.
Changes
Changes to the FreshClick service and plan prices
FreshClick reserves the right to modify or discontinue the service temporarily or permanently with or without notice.
Prices and features of all plans are subject to change with 30 days notice. Notice may be provided by posting changes to the FreshClick site or service.
FreshClick will not be liable to you or anyone for modification, price change, suspension, or discontinuance of the service.
Copyright
Copyright and content ownership
You retain all intellectual property rights over content in your account. Your profile and uploaded material remain yours.
FreshClick has the right in its sole discretion to refuse or remove content available through the service.
General
General conditions
The FreshClick service is provided on an as-is and as-available basis.
FreshClick uses third-party vendors and hosting partners to provide the hardware, software, networking, storage, and related technology required to run the service.
If you use the FreshClick website and service, you consent to the transfer and storage of content and profile information on servers in the United States and United Kingdom.
FreshClick may remove content and accounts containing content it determines to be unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene, otherwise objectionable, or in violation of intellectual property rights or these terms.
You must not transmit worms, viruses, or destructive content.
FreshClick does not promise that the service will be uninterrupted, timely, secure, or error-free. It makes every effort to satisfy requirements and expectations but makes no promises in this regard.
FreshClick cannot be held liable for system downtime, crashes, data loss, or predicted profits a client would have gained if the service was functioning.
Failure to exercise or enforce any right or provision does not constitute a waiver. These Terms of Service supersede prior agreements or versions and are governed under United Kingdom law.
If you provide information to FreshClick, you consent to transfer and storage of that information on servers in the United States or United Kingdom.
